Terms of Service

1. Acceptance of Terms

By accessing or using WORKWARS ("the Platform", "we", "us", "our") at workwarsofficial.com, workwarsofficial.ca, or workwarsofficial.app, you ("User", "you") agree to be bound by these Terms of Service and our Privacy Policy. If you are using the platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Platform Description

WORKWARS is a multi-sided software platform providing:

• Worker App: A secure incident documentation tool for employees to log workplace incidents with server-verified timestamps.
• Advocate Portal: A B2B marketplace for employment lawyers to discover anonymous legal leads and connect with workers seeking counsel.
• Compliance Portal: An enterprise HR dashboard for organizations to monitor and resolve workplace compliance issues internally.
• Agency Portal: A safety monitoring dashboard for staffing agencies overseeing external job sites.

3. Not Legal Advice

WORKWARS is an educational documentation platform and software tool. We are not a law firm. Nothing on this platform — including guides, checklists, incident log templates, or any content in the Worker Defense Library — constitutes legal advice or creates an attorney-client relationship.

4. Eligibility

You must be at least 18 years old to use WORKWARS. By using the platform, you represent that you are 18 or older. Advocate Portal access is restricted to licensed legal professionals. Compliance and Agency Portal access is restricted to verified organizational accounts with active subscriptions.

5. Worker App Terms

As a Worker App user, you agree to:

• Provide truthful and accurate incident information to the best of your knowledge.
• Not use the platform to file false, fabricated, or malicious incident reports against employers or individuals.
• Not use your account to harass, defame, or target individuals with false claims.
• Understand that the platform is a documentation tool — it does not file complaints on your behalf with any government agency.
• Be solely responsible for any legal action you choose to take based on your documentation.

The free tier includes a limited number of incident logs per year. Additional logs and features are available via paid subscription.

6. Advocate Portal Terms

As an Advocate Portal subscriber, you agree to:

• Maintain an active, valid license to practice law in your declared jurisdiction.
• Use lead information obtained through the platform solely for the purpose of evaluating and potentially representing the worker whose case you unlocked.
• Not share, sell, or transfer worker contact information obtained through the platform to any third party.
• Comply with all professional conduct rules applicable to your bar membership regarding solicitation and client intake.
• Maintain confidentiality of all case information consistent with attorney-client privilege standards.

WORKWARS reserves the right to terminate Advocate Portal access without refund if a subscriber is found to have violated these terms or their professional conduct obligations.

7. Compliance & Agency Portal Terms

As a Compliance or Agency Portal subscriber, you agree to:

• Use the platform only for legitimate internal compliance monitoring and safety management purposes.
• Not use the platform to identify, retaliate against, or discipline individual workers based on incident data.
• Not attempt to de-anonymize worker reports or identify individual reporters through any means.
• Understand that marking an incident as "Resolved Internally" does not prevent workers from pursuing independent legal action or government agency filings.
• Comply with all applicable employment, labor, and privacy laws in your jurisdiction.

8. Marketplace & Bid Credit Terms

The Advocate Marketplace operates on a Bid Credit system. By participating:

• Bid Credits are non-refundable once a lead has been successfully unlocked.
• Each Bid Credit unlock is an atomic transaction — credits are deducted and lead access is granted simultaneously. No partial transactions occur.
• Lead information is provided as-is. WORKWARS does not guarantee the outcome of any legal matter arising from a marketplace lead.
• Workers retain the right to decline representation from any advocate who contacts them, regardless of credit expenditure.
• WORKWARS does not participate in any fee arrangement between advocates and workers.

9. Prohibited Uses

You may not use WORKWARS to:

• File false, fabricated, or malicious incident reports
• Attempt to de-anonymize other users or identify individual workers
• Scrape, harvest, or bulk-download platform data
• Attempt to bypass authentication, App Check, or security controls
• Use automated tools (bots, scripts) to interact with the platform
• Engage in any activity that violates applicable law
• Impersonate another person or organization
• Interfere with the platform's security or operational integrity

10. Evidence Responsibility

Users are solely responsible for the preservation, backup, and security of device-stored evidence files. WORKWARS cannot recover local data deleted from your device. We are not liable for data lost due to device failure, browser cache clearing, operating system updates, or account deletion.

By uploading evidence to the platform, you represent that you have the legal right to possess and share that material, and that doing so does not violate any applicable law (including wiretapping or recording consent laws in your jurisdiction).

11. Payments & Refunds

All payments are processed securely by Stripe. WORKWARS does not store payment card information. Subscription fees are billed in advance and are non-refundable except where required by applicable law. Bid Credits are non-refundable once purchased. If you believe you were charged in error, contact us within 30 days of the charge.

12. Intellectual Property

All platform content, including the Worker Defense Library guides, templates, and checklists, are the intellectual property of WORKWARS. You may use these resources for personal, non-commercial purposes. Reproduction, redistribution, or commercial use of platform content without written permission is prohibited.

You retain ownership of all incident log content and evidence you create or upload. By using the platform, you grant WORKWARS a limited license to store, process, and transmit your content solely as necessary to provide the service.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WORKWARS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF LEGAL OPPORTUNITY, ARISING FROM YOUR USE OF THE PLATFORM.

Our total liability to you for any claim arising from these Terms or your use of the platform shall not exceed the amount you paid to WORKWARS in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless WORKWARS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or behavior that harms other users or the platform. You may terminate your account at any time by requesting data erasure through the platform settings or by contacting us directly.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. For users in Quebec, applicable Quebec consumer protection and privacy laws apply. For users in the United States, applicable federal and state laws apply. Any disputes shall be resolved through binding arbitration or in the courts of Ontario, Canada, except where prohibited by local law.

17. Changes to Terms

We may update these Terms periodically. We will notify registered users of material changes via email or platform notification. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
